Terms and Conditions – Holistic Health & Sexuality LLC (New Mexico, USA)
1. Scope
These General Terms and Conditions (GTC) apply to all consultations, coaching sessions, online courses, digital products, and other services offered by Holistic Health & Sexuality LLC , registered in New Mexico, USA.
They apply to consumers and businesses worldwide unless a more specific agreement has been made.
2. Type of services / Distinction from therapy and medicine
The services offered are sex education, counseling, and educational programs.
They do not constitute psychotherapy, medical treatment, or healing .
No diagnoses are made, and no promises of cures are given.
Customers are responsible for seeking professional help in case of health, medical or psychological problems.
3. Conclusion of the contract
A contract is concluded when customers:
• book a session or product via the website,
• confirm a booking in writing,
• or purchase a digital product.
By booking, customers confirm that they have read and accepted these terms and conditions.
4. Prices, Payment & Currency
All prices are listed on the website.
Billing is in euros (EUR) unless another currency has been explicitly agreed upon.
Payment is made in advance via the offered payment providers (e.g., Stripe, PayPal, bank transfer).
Installment payments are possible if agreed upon in writing beforehand.
5. Cancellation & Rescheduling of Individual Sessions
• Cancellations or changes to bookings are free of charge up to 24 hours before the start
. • For cancellations made later or in case of no-show, the full price will be charged.
• The 24-hour deadline also applies to changes to bookings.
Coaching packages
Unused sessions expire after 6 months unless otherwise agreed in writing.
6. Right of withdrawal (EU/UK customers)
Services (1:1 sessions, coaching packages)
Customers from the EU/UK have a statutory right of withdrawal of 14 days.
However, this right expires as soon as:
the service has started and
Customers have expressly agreed that the right of withdrawal expires upon commencement of the service.
This is done during the booking process through a separate active confirmation field.
Digital content / Online programs
For purely digital products (e.g. downloads, videos, PDFs, online courses) there is no right of withdrawal once:
• the download has taken place or
• digital access has been activated.
This is also explicitly confirmed during the ordering process.
7. Liability
The provider is liable only for damages resulting from intentional or grossly negligent breaches of duty
. Liability for slight negligence is excluded to the extent permitted by law.
Liability is specifically excluded for:
• health or psychological damage,
• economic or personal decisions of the customers,
• lack of success or unmet expectations,
• technical problems on the customer's side.
Participation is entirely at your own risk.
8. Customer Obligations
Customers agree to:
• provide relevant information truthfully,
• not expect medical or therapeutic services,
• seek professional help in case of acute mental or health problems,
• be punctual and respectful with the booked time.
9. Confidentiality & Data Protection
All personal content from sessions will be treated confidentially.
Personal data is processed in accordance with the laws of New Mexico, USA , and – for EU/UK customers – additionally in accordance with the GDPR/UK GDPR .

10. Online sessions & technical requirements
Sessions take place online (e.g., via Zoom).
Customers are responsible for ensuring a stable internet connection.
No refunds will be issued for technical problems on the customer's end.
11. Copyrights
All content (materials, PDFs, videos, audios, exercises, scripts) is the intellectual property of Holistic Health & Sexuality LLC.
It may not be reproduced or distributed without written consent.
12. Self-responsibility & health prerequisites
The services are aimed at adults in stable physical and mental health.
By booking, customers confirm that they are acting on their own responsibility and agree to indemnify the provider against any third-party claims, to the extent permitted by law.
13. Applicable Law & Jurisdiction
The law of the state of New Mexico, USA , applies .
For consumers within the EU/UK:
Mandatory consumer protection regulations of the respective country of residence remain unaffected.
Legal action can be taken where legally required.
14. Changes to the Terms and Conditions
Holistic Health & Sexuality LLC may change these Terms and Conditions at any time.
The version available on the website at the time of booking applies.
